Welcome to PhillyMatch. PhillyMatch is operated by Philadelphia Psychometric Matching LLC, a Pennsylvania limited liability company ("PhillyMatch," "we," "us," or "our"). By creating an account or using our website at phillymatch.org or our mobile application (together, the "Service"), you agree to these Terms of Service ("Terms") and to our Privacy Policy, which is incorporated by reference. If you do not agree, please do not use the Service.
1. Eligibility
- You must be at least 18 years old to use the Service. By using it, you represent that you are 18 or older and legally able to enter into a binding agreement.
- The Service is intended for adults located in the United States, and is designed for people in the Northeast U.S. It is not directed to residents of the European Union, the United Kingdom, or the State of California, and we do not knowingly offer it to them.
- You may not use the Service if you have been convicted of a felony or any crime involving violence, sexual misconduct, or fraud, or if you are required to register as a sex offender.
2. Your account
- Provide accurate, current information when you register and keep it up to date. Use your real name and your own photos.
- You are responsible for keeping your password confidential and for all activity under your account. Tell us right away if you believe your account has been compromised.
- One account per person. Do not create multiple accounts, share your account, or impersonate anyone.
- Optional identity verification is provided by an independent verification service (currently Didit). If you choose to verify, you consent to document, selfie, liveness, age, and fraud-prevention checks performed by that provider under its own terms and privacy policy.
3. Acceptable use
PhillyMatch is a community, and we expect members to treat each other well. You agree not to:
- Harass, threaten, stalk, intimidate, or harm other members, or contact a member who has asked you not to.
- Post content that is illegal, sexually explicit, hateful, violent, defamatory, or that infringes anyone's rights, or post photos of anyone other than yourself without their consent.
- Use the Service for commercial purposes, including advertising, soliciting, escorting, or promoting other websites or services.
- Ask other members for money, gifts, financial information, or anything of value, or engage in any scam or fraud.
- Share another member's personal information, messages, or photos outside the Service without their consent.
- Use bots, scrapers, or other automated means to access the Service, or attempt to circumvent security, reverse-engineer the Service, or interfere with its operation.
- Misrepresent your identity, age, location, or intentions.
We may remove content, restrict features, or suspend or terminate accounts that violate these Terms, without notice and at our discretion. We may also report unlawful conduct to law enforcement.
4. Free service and paid features
- Creating an account, completing the questionnaire, browsing matches, and messaging are free.
- Some optional features (for example, boosting your profile, being listed as a featured member, or a Premium membership) are paid for with credits. Credits are purchased through our payment processor on the website or through Google Play Billing in the Android app.
- Prices are shown before you buy. Credit purchases are final and non-refundable except where a refund is required by applicable law or by the policy of the platform through which you purchased (for example, the Google Play refund policy).
- Credits have no cash value and cannot be transferred, exchanged, or redeemed for cash.
- We may change the features available for credits, or their prices, going forward; changes do not affect credits you have already spent.
5. Your content
You keep ownership of the photos, text, and other content you post. By posting content, you grant us a non-exclusive, royalty-free, worldwide license to host, store, display, and distribute that content solely for the purpose of operating, securing, and improving the Service. This license ends when you delete the content or your account, except for copies that may remain in backups for a limited time or that other members have already received in messages. You represent that you have the right to post everything you post.
6. Questionnaire and matching
PhillyMatch ranks members by the similarity of their questionnaire answers. The similarity score is an estimate produced from self-reported answers; it is not a guarantee of compatibility, and we make no promise that you will find a match, a date, or a relationship. The questionnaire and the methods used to score it are our intellectual property and may not be copied, reproduced, or used to build a competing service.
7. Safety
We do not conduct criminal background checks on members. Identity verification, when a member chooses to complete it, confirms that an ID document matches a live person; it does not vouch for anyone's character or intentions. You are solely responsible for your interactions with other members, online and offline. Please read our Safety page and use good judgment, especially when meeting in person or when anyone asks you for money.
8. Privacy
Our Privacy Policy explains what information we collect, how we use it, and the choices you have. In short: your questionnaire answers are used for matching and nothing else, and we do not sell personal information.
9. Termination
You may delete your account at any time from your account settings or by contacting us. We may suspend or terminate your access to the Service if you violate these Terms, if we are required to by law, or if we discontinue the Service. Sections 5 through 12 survive termination.
10. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted or error-free, that any member is who they claim to be, or that you will achieve any particular result. We are not responsible for the conduct of any member, on or off the Service.
11. Limitation of liability
To the maximum extent permitted by law, Philadelphia Psychometric Matching LLC and its members, managers, employees, and agents will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of data, profits, or goodwill, or for emotional distress, arising out of or relating to your use of the Service or your interactions with other members. To the extent any liability is not excluded, our total liability to you for all claims will not exceed the greater of the amount you paid us in the twelve months before the claim arose or one hundred U.S. dollars (US$100).
12. Governing law and disputes
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-law rules. Any dispute arising out of these Terms or the Service will be brought exclusively in the state or federal courts located in Pennsylvania, and you consent to their jurisdiction, except where applicable law gives you the right to bring a claim elsewhere.
13. Changes to the Service and to these Terms
We may modify or discontinue features of the Service at any time. We may also update these Terms. If a change is material, we will notify you by email or through the Service before it takes effect. Continuing to use the Service after a change takes effect means you accept the updated Terms.
